The high court of Bombay confirmed on Wednesday the release of a film, which is probably named “the director Shaadi Karan and Johar” or “the director Shaadi Karan Johar”. The court said that the name violates the personality and promotional rights of filmmaker Karan Johar.
A bench of chief judge Alok Aradh and judge Ms. Karnik said that Johar had acquired an “excessive reputation” in India and the world entertainment industry.
The bench rejected the producer of the film Sanjay Singh, who challenged the ordinance given by the unique bench of the High Court to prohibit the release of the film. The unique bench passed the petition order deposited by Johar against the film and its title.
The court said that “Karan” and “Johar”, when used together (in the title), underlined the famous personality and filmmaker Karan Johar. The High Court said that since the name of Karan Johar had become his special identity, the director has the right to use it according to his discretion.
The court declared in its order: “The name Karan Johar is completely associated with the number one defendant (Karan Johar) and is an important part of his” personality and his brand “.
The bench said that the accused (Johar), being a famous personality, deserves the protection of his personality and his advertising rights and can claim protection against commercial exploitation unauthorized by the third party.
