This is unconstitutional...; US judge bans Trump's order on birthright citizenship

US President Trump’s decision put on hold

New Delhi:

A court in the country has put a stay on President Donald Trump’s decision to end US Automatic Birthright Citizenship in America. This decision of the court would have brought great relief to thousands of immigrants living in America, who were worried about their future after Trump became President. In his decision, the judge termed Donald Trump’s executive order as ‘clearly unconstitutional’. President Trump had abolished the right to birthright citizenship through an executive order on the very first day after taking office.

What did the court say on Trump’s order

Against this decision of the court, 4 Democratic led states Washington, Arizona, Illinois and Oregon had approached the court in this matter. A judge in Seattle on Thursday blocked President Donald Trump’s administration from enforcing an executive order limiting the right to birthright citizenship in the United States. The judge defended Trump’s order against the U.S. A lawyer from the Justice Department said that this is a clearly unconstitutional order. “Under this order, children born today will not be considered American citizens,” Washington Assistant Attorney General Len Polozola told Senior US District Judge John Coughnour at the start of the hearing in Seattle.

Trump had given this order

Polozola, on behalf of the Democratic state attorneys general of Washington, Arizona, Illinois and Oregon, urged the judge to issue a temporary restraining order to prevent the administration from implementing Trump’s order. The argument of those challenging Trump’s order is that it violates the citizenship rights of the 14th Amendment of the Constitution, which provides that any person born in the United States is a citizen. In his executive order, Trump directed US agencies to refuse to recognize the citizenship of US-born children whose parents are not US citizens or legal permanent residents.
