Explained | The hand of Saif Ali Khan declared precious property with a value of Rs 15,000 crores, ancestral goods “enemy property” have been declared

The high court of Madhya Pradesh shocked Saif Ali Khan, rejecting the actor’s petition in which he challenged the government’s decision to mark his ancestral properties worth 15,000 roots as “enemy property”. The High Court rejected the order of the 2000 First Instance Court, in which Saif Ali Khan, his Sisters Soha and Saba and Mother Sharmila Tagore were considered the successor of ancestral properties.

The court ordered the court of first instance to hear a new hearing on the dispute of succession of property and to set a time limit of one year. Under the 1968 law on enemy properties, the central government is authorized to claim assets belonging to people who went to Pakistan after the score in 1947.
The Pataudi family claimed its land to Bhopal and Raisen, notably the Kohefiza flag house, the Palais of Ahmedabad, Kothi and the Jungle located in Chiklod in Raisen. He said he had properties like Nur-E-Sab, Flag House, Dar-Aus-Salam, Force Quarter, New Quarter, Persia Khana, Kohefiza and Ahmedabad Palace.

-Haycourt ordered the court of first instance to resume the case and give a new decision within one year. Other families of Nawab Hamidullah Khan challenged the old decision and required a fair distribution of goods under Muslim personal law.

It should be mentioned that the Court of First Instance gave all ancestral property to Sajida Sultan, the daughter of the elder Begum of Nawab, who has now been disputed by other successors.
 
According to Harshit Bari, the lawyer for Hycourt, the case will be heard again and the new decision will decide who and how much the right to ownership of Nawab should obtain.
 

What is the case?

In 1947, Bhopal was a princely state and his last Nawab was Nawab Hamidullah Khan, who was the maternal grandfather of Mansoor Ali Khan Pataudi. Nawab Hamidullah Khan had three daughters, whose sultan moved to Pakistan in 1950. Her second daughter Sajida Sultan remained in India and she married Nawab Dada Nawab Dada Dada Ali Khan Pataudi and became a legal property heir.
The descendants of the princely state of Bhopal – Begum Suraiya Rashid, Begum Mehar Taj, Sajida Sultan, Nawabjadi Qamar Taj Rabia Sultan, Nawab Meher Tajida Sultan and others filed two calls before the High Court in 2000 against the order passed by the Bhopal district court.
The appeal said that Nawab Hamidullah Khan died on February 4, 1960 and that the princely state of Bhopal was merged with the Indian Union on April 30, 1949. According to the written agreement, the Nawab’s special rights will continue after the merger and the full property of private property will be successful under the Bhopal Gaddi Act 1947. After the death of Hamidullah Nawab. The government published a letter on January 10, 1962 to mention ancestral property under article 366 (22) of the Constitution.
 
After the death of Nawab Hamidullah Khan, his personal property should have been divided between the applicant and the defendant according to Muslim personal law. The request was submitted to the Bhopal district court demanding the succession of property. However, the district court rejected its request on the basis of the decision adopted by the High Court of Allahabad.
 
The high court of Madhya Pradesh, in his order, said that the court of first instance had rejected the case in accordance with the order adopted by the High Court of Allahabad without considering other aspects of the case. He said that the Court of First Instance had not examined the fact that the law on the succession of the throne had been canceled by the Supreme Court of the merger.
 
In the call, Mansoor Ali Khan Pataudi, his wife Sharmila Tagore, his sons Saif Ali Khan and his daughters Saba and Soha were made defendants. In 2015, the Soutru property office, based in Mumbai, said the country of Bhopal Nawab as government property, after which the Pataudi family approached the court.
 
In 2019, the Court recognized that Sajida Sultan was a legal successor and his grandson Saif Ali Khan inherited part of the properties. However, the central government claimed properties as “enemy goods” while Abida’s sultan left for Pakistan.
