The Supreme Court of Britain ruled on Wednesday, 16 April that the legal definition of “woman” is based on the gender (sex) of that person at birth. The matter was taken to the Supreme Court in London to take the gender-critical campaign of Scotland and the decision that has come is a victory for them. The five -judge bench unanimously ruled that the ‘Women’ and ‘sex’ which has been used in the Equality Act 2010 of Britain Act means a biological woman and biological sex. That is, the girl who was at birth, she will be considered a woman.
The British government welcomed it as a woman who is a woman to bring “clarity” in the debate.
What is the dispute going on in Britain?
The debate or fighting that was going on for the years of Scottish government and campaign group for women Scotland (FWS) was brought to court. These campaign groups started an appeal in the Supreme Court after losing arguments in Scottish courts on a vague law made aimed at hiring more women in public sector jobs.
FWS and other gender-critical campaigners argue that biological sex cannot be changed. That is, the girl who is at birth will be the woman and the boy who is the boy will become a man ahead. After the decision came, he welcomed the decision outside the court and crying.
At the same time, the Scottish government said that it accepts the decision and will focus on “protecting everyone’s rights”. At the same time, Trans rights activists had expressed concern that due to the decisions in favor of FWS, the sex people who have chosen for themselves, could be at risk of discrimination against them.
Why are rights groups afraid of judgment
Scottish Greens Activist and 25 -year -old Trans lady Ellie Gomersal told Sky News that the decision is “another attack on the rights of the trans -people to live life in peace”.
The law at the center of this legal battle is the equality law of 2010. Its two different interpretations were being done and there was a dispute. The Scottish government argued that the equality law provides equal protection to women who have a gender identity certificate (GRC) as a woman (biological woman) from birth. But FWS disagreed with this decision of the government.
In its judgment, the Supreme Court has ruled that the “interpretation of the Scottish government is not correct” and the 2010 Equality Act does not match the gender identity law in 2004, it is inconsistent with it. The law of 2004 presented the GRC certificate.
